Fair use/transformative content is what allows my channel to exist, but a lot of people seem to get confused about it. By request I made this video to give you a short lesson on what is, and isnt fair use. Hope this helps all you aspiring video editors!

Two years later, this video remains relevant today. I find myself going back to researching the basics so as not to get lost after watching easy ways to get monetized by reuploading content on YouTube. And this video is a clear and simple explanation of what is transformative and fair use while working around what is legal.

What if I make an edit and add a moderate amount of kinks and touches to the video, add text, and added effects such as shakes, fading, etc? Is that considered fair use?

what if i use a movie scene or gameplay whatever and mute the sound of it put my song on the video and a music cover so that the content only runs in the background? is that transformative?

Hi! I just found this video and I am trying to get into making fan edits and stuff for HTTYD and other franchises. I figure if I am making a theory video or a video pointing out parallels between the movies and shows that would count as transformative, as I am providing a sense of commentary. However, I was wondering if I took clips from the movies and shows but cut the audio and put different music behind it from YouTube shorts if that would count as transformative or not? This would fall more under the category of an edit rather than commentary. I really like making videos, but I want to make sure that I am doing it right.

What if I’m doing a doc on someone with permission of the estate and want to use a scene from a film they were in. My idea was to use screen grabs vs video and to alter the images with a comic book filter and all dialog is removed and read by another person as it is a speech from the film. Is that transformative enough? It’s no longer in color it’s blue, black and white.

What if I use a 15 second clip of someone's content but I do a voice over on it? Is that considered transformative?

Does changing the play speed noticeably, count for fair use as the content is obviously edited and not the original but is still really the same thing?

Very interesting, it’s also worth pointing out that if something is created as a parody or you are giving commentary for the sake of review it SHOULD be considered fair use, but as you say, doesn’t always mean much when YouTube always sides with the copyright holder.
A great filmmaker I encourage people to check out is Matt Johnson and particularly his show Nirvanna The Band The Show which is entirely built around pushing the limits of fair use. They had a fair use lawyer attached to the show to ensure everything they used (a lot of movie references) were passable. One loop hole was that if the copyrighted material is FUNDAMENTAL to you telling your own original story it can be considered fair use. You can check out the show to see what I mean. (The show is incredible and painfully under seen)

Dude I just want to say amazing video. I make content using a mix of different found footage clips which I narrate over. Every now and again I cut to a quick clip of someone saying something that relates to something I’ve just said or buttresses a point I’ve made. Sometimes if I get these interviews from big channels they come after me. Now if I was to throw a filter over top and put my face waving in the top corner would that be transformative?

My impression is that on average, 10-20 second clips are ok before you add your own commentary.. This is something I heard a long time ago..

Will this work on YouTube?

I've always wanted to create a YouTube channel centered around telling stories through text and sound effects alone, kind of similar to Drama CDs though rather than voice acting, you get text dialogs instead, but you see, I've always been having second thoughts about it due to the fact that I have no idea how copyright works in YouTube.

Why copyright, you say?

Being broke as I am, I can't exactly commission someone to make the sound effects for me nor do it myself as I have no idea how to, so the next best solution my small brain could come up with is to snip few or so seconds of the sound effects I needed from probably copyrighted contents on YouTube or download them from the internet.

Which brings me back to the question: Will this work on YouTube? Or will the channel just be riddled with copyright claims? Could I call it "Transformative Content"? Is it fair use? If so, will I even be able to monetize it?

Please do share me your thoughts regarding this matter, thanks in advance!
