This video is only if you were NOT served but still have a judgment against you. I lay out the steps we use when clients hire us to attack judgments that are void because our client was not served.

Hope this gives you some ideas and thanks for watching!

John

PS -- I mentioned something about if you were served, then you use rule 50 to see how to set aside. It is actually rule 55. :)

Thank you for all your videos. They are helpful for all cases, not only debt collection.

Does a creditor (local government council rates) need to advise debtor of a caveat on certificate of title of land beforehand?

Let’s say if you were served on a Sunday or a holiday… If you were served improperly you can file a motion to dismiss the case?

I was served an order to vacate property. But they had the wrong address on there. Is the order still good?

You're screwed if you can't prove that you weren't in the location they claimed you were at.

Update: I was able to get a hearing after filing a motion. OUTCOME: I lost. Even though the summons never touched my hands or eyesight, the judge dismissed my motion because my daughter was the one who signed for the summons that I never saw. Now I am really going to have to get a lawyer involved and I can't afford one. To date, they have received over $18, 000. The whole deal was truly predatory lending on first-time home buyers.
