It's difficult to argue this topic because of extensive extenuating circumstances that surround the situation, particularly in terms of trying to apply _our_ universal laws on _their_ universe.

The quick and dirty answer would be that if the Joker were tried in our universe, using our means of justice (if we assume a western judicial system, ) then yes, he would be found guilty and, depending on the country, be put to death quickly, without a doubt.

The problem lies in analyzing how the Joker's universe would handle him. From our perspective (as the reader, ) the DC universe is deterministic, with all the plot points laid out and the creators of this universe, or authors for short, having decided his fate well before the reader has turned the first page. Therefore, our theories and judgments are rendered moot since the topic was already decided well beforehand.

BUT, if we were to entertain the notion of seeing what outcome would come from trying Joker for his crimes, then the whole of the DC multiverse must be considered before rendering a verdict as there are forces well outside of the Joker that would drastically alter the verdict.

To do this, we must first ask _is death a bad thing?_ I know, a strange and worrying question but hear me out. While Joker is responsible for the death of hundreds of millions lives (I'm including the time he was Emperor Joker, ) supreme beings like Dr. Fate or the Spectre or the Monitor could have and probably should of intervened as their sole duty is to maintain balance. Yet, they stand by and idly watch his mayhem unfold without a second thought. Are these beings, whose authority far out ranks those of mere mortals, saying his killing is just or perhaps _necessary?_ Who is to say?

Even if we omit these supreme beings from the equation, we must then ask _if death still exist?_ Tell me, how many times has Batman died? Robin? Alfred? How about the Joker himself, how many times has he stone cold died? If it's more than "once, " we have a problem.

Death has been made irrelevant in-universe, at least for those who are relevent. Should one die, there are many avenue in which one may reverse said death. The Lazarus Pit, time travel, all sorts of magics and spells, advanced alien technology, cloning, demon pacts and divine interventions, punching the multiverse super hard (thanks for that one, Super Boy.) The worst example of these Deus Ex Machinas is 10th Metal, which grants its user the ability to _alter reality itself!_ If any of the DC heroes were honest with themselves, they would have used any and all of these means to resurrect the trillions who died during their careers yet they choose not to, or so it seems from our perspectives. Again, their lives are not truly their own but belong to the authors, as is the nature of their deterministic existence.

Ultimately, it is difficult to judge the Joker since, for the most part, his crimes are rendered meaningless due to the vast plethora of get-out-of-genocide-free cards that are readily available in the DC universe. Therefore, we can't judge him based on our laws and our universal constants because he and his victims operate in strange, nightmarish existence where death is meaningless and their actions are not wholly their own. Even if he were found guilty and executed, there's no guarantee that he will remain dead and may even return as something _far worse..._

Unlike everypne else in the comments I'm going to say no. Joker, unlike many other Batman rogues can't change even if he wants to. Joker literally is basically having a chemical imbalance in his brain he cannot change but others can. It's not because he's a pure evil being. In The Killing Joke Joker's real name was Jack Napier a down on his luck comedian who couldn't make much money supporting his pregnant wife. He made a deal with some thugs and help them rob a chemical plant. But his wife got into an accident and her and the baby died. Jack tried to back out of the heist, but the criminals literally threatened his life. All he had to do is distract Batman as the infamous Red Hood. Jack got scared and fell of the railing landing into the vat of chemicals which turned him insane. Alot of people tend to redeem other rogues saying "they didn't have a choice to be evil" when one can argue that they did. I ask you all this, where was Jack Napier's choice?
