Показать описание
The original case law goes back to Ninth Circuit Court of Appeals case called Milke v. Ryan - U.S. Courts. In 1990, a jury convicted Debra Milke of murdering her four-year-old son, Christopher. The judge sentenced her to death. On March 14, 2013, the U.S. Court of Appeals for the Ninth Circuit threw out Milke's conviction, ruling that Milke did not receive a fair trial. It held that Milke's rights had been violated by the failure to turn over Saldate's personnel file to the defense.
It is up to the prosecutor to turn over any prior misconduct by a police officer, however the police department in Las Vegas has their own attorney which will attempt to blog your "motion to compel" which is how to find it bad cop. Unfortunately, a most police officers are good people who actually want to protect and serve, but every so often a bad cop with poor ethical standards enters the system and the district attorney does not want to let the opposing counsel know this information, especially before a court trial even though it is their duty as a prosecutor to present it.
Also, unfortunately "bad cops" have been getting a lot of news coverage lately via Walter Scott and shot running away please stop South Carolina as well as a number of older police brutality cases that have been getting a lot of coverage in the news in recent months. I do a continuing legal education course for other lawyers and one of the subjects we delve into quite often is how to go up against the police department and the district attorney to find out if you are dealing with a corrupt cop and what you can do to bring that evidence to light to help defend your client in court who may be guilty of nothing other than being prosecuted by an "bad cop".
If you think this is the case, and you are being investigated by the police department in Las Vegas, Clark County or anywhere in Nevada and you need to find the files on the police officer who is charging you and you don't think the arrest was done fairly please comment my office and talk to me as soon as possible.
