Can You Get Child Support Back If You Are Not The Father?

A family law attorney can look into this for you but it depends on multiple factors like if you were on the childs birth certificate or if there was a formal agreement in the courts. When it comes to family law, you really need an attorney to assist you when it comes to the specifics of your case.

I would be suing the mother and the biological father for all the money I spent on *their* child.

The court goes by what the mother says but when you fill out the form it asks who all you have slept with during the time of conception and most women list one person and when the man doesn't show up to court the he is the father by default and that is messed up.

Family lawyer here. Short answer,
Not a chance. You’d spend more money trying to make new law to recoup the payments. And the courts would never allow it.

Many courts do not care. The key phrase here is "what is in the best interest of the child". I have seen men who are clearly not the father, mom says so, he says so, DNA test says so, the real recognized father says so, the court acknowledges all of this, but makes the not father keep paying child support because he has more money than the not father. Good luck getting any child support back.

1989 I received a court order to show up for court, in it the statement from the state of Ohio said, “ if you do not show up you will be found to be the father and court ordered to pay child support”. I was home on leave and visited my younger siblings at my dad’s luckily, my father opened it but never got it to my mother home. I requested the court to allow me to do my part in Virginia since it was my next duty station, a few months go by and I get court papers to do my part. Knowing the state of Ohio let all parties involved know when, where and what to do since the mother of the child is getting state aid, she doesn’t do her part. Fast forward 10 years I try again but mother of the child’s is against it. Now in 2024 the mother and other possible father have passed, the adult child does like I tried getting her to do, DNA and neither myself or who she thought was her dad are her biological father. A 3rd male who is alive but wants nothing to do with her. Now the adults child pays for all of this.

Wish the law would pass, to identify who 2:31 is father after birth, would resolve this issue, as in DNA testing

My ex-wife had collected child support from me from 2007-2017 or 2018. I don't remember the exact date it ended. When my son graduated high school, child support did an automatic review because he turned 18 and finished school. Child Support garnished my wages AND took my income taxes for child support, and I still was in arrears. To make a long story short, after some legal issues my ex had, the kids were found to not be in her care, and I was still paying her child support. Because of this, my whole child support case ended and due to me being in arrears, they deemed me as caught up in support and I was ordered as no longer owing child support. There are copies of the order being ended. They specifically told me that if I didn't have the review done, I'd still be paying support.... THEIR EXACT WORDS. But they told me I would have to go after her to get the overpayment back. My question is how can they tell me that I have to go after her when THEY made the mistake of not knowing I was still paying her the child support? Is that even possible or legal of child support to do that? It's been at least 5 to 6 years, and I STILL haven't heard anything about it. Any information or help would be greatly appreciated.

My bm had an existing daughter. She got pregnant 3 months into our relationship. 9-10 months later gives birth. Her existing daughter was in foster care until a few months after our child was born. My existing daughter calls me dad. It was clearly stated from the beginning that the child would know I'm not her father. 2 years after my bm existing daughter came 6 my life, I was asked to leave. She told me she had a new, more reliable guy. That i should thank for doing things for the girls when i couldn't fulfill one of the mothers' demands one night. I said that guy can raise your daughter then. Now she's threatened to take me for child support bc she call me dad. She's refused to find the real father.

It's time for mandatory DNA testing before any birth certificate is completed. It's not ok to defraud a man of his progeny! It should be a crime! Every child deserves to know who their parents are. It's called basic human decency!

But if your parent was an x con. You could claim institutionalized mental issues. Or a family of former and xcons. You could have been very uninformed and coaxed into something you knew nothing about. Especially if you served at certain times in the military. The brain washing thing.

There's various ways to get it back. You either physically get the actual cash back thru the court, or you punish all involved in the scheme, with the help of friends, family, private investigators, etc. You may have to get in the gutter to carry out the proper punishment.
