Judge Fleischer: Drunk Driving Debry
Показать описание
The courtroom was a veritable circus of inebriated individuals. A man, clearly tipsy, had nearly careened into a police cruiser, his disregard for lane discipline and turn signals a testament to his disregard for road safety. Three other gentlemen, equally intoxicated, had also graced the courtroom with their presence. One had been found passed out behind the wheel, his hazard lights flashing a silent SOS. Another had boldly run a red light, perhaps mistaking it for a green one through his alcohol-fogged lenses. And finally, a man stopped for a mere expired tag had been found with an open container, proving that even the most minor traffic violation can lead to the most major revelations.

Due to freedom of information and access, public citizens are granted insight to the court system and other government agencies. Public opinion and interest may at times impact the privacy and impartiality of court proceedings and court records, however, these freedoms are incredibly valuable. Public access to records and proceedings holds the courts accountable by ensuring any errors, oversights, and injustices are perfectly transparent. Ultimately, this freedom helps elevate our justice system to the highest standard of accuracy and integrity.
Likewise, the First Circuit has held that under the First and Fourteenth Amendments, “the public and the press enjoy a constitutional right of access” to criminal proceedings, “most pretrial proceedings” and “to documents and kindred materials submitted in connection with the prosecution and defense of criminal proceedings.” In re Providence Journal Co., 293 F.3d 1, 9 (1st Cir. 2002).
