I've recorded all my calls for years. It's a self defense thing.
I don't keep the recordings 90% of the time, but it's a lot easier to have your phone set to record than find a way to start recording during the call.

Get burnt enough times and you start doing things like that.

Eta: I'm not speaking to the ethics of the way he used it, one way or the other. But recording calls isn't a big deal, and it's definitely not criminal in the state of Texas.
