I have had tenants who have called me to let me know that they were not going to have the money at the beginning of the month. I have worked with them to move the date that the rent would be due back a few days for that month. With a little leeway, they were able to pay the rent.

Yes, I wish they would manage their finances better, but I can't control everything. I just try to be reasonable. I have had to threaten a couple tenants with eviction, but not for rent evasion. The first tenant I had to remove because he was not keeping his unit clean, a violation of the lease. The second tenant relapsed into alcoholism and became threatening, not a lease violation, but resulted in me giving him a notice to vacate. Every tenant that respected the property and me always gets reasonable treatment.

We’re going to eviction court in the morning for first time as landlords with someone who rented from us for 6 years. She’s 2 months behind on rent and trashed the porches and inside looks bad too. We’ve been managing the rental ourselves but after this we’re going to hire a property management company if we lose or win.

I live in the same house as my landlord for 6 years - i pay him paper cash on time, every time, i respect his home. we don't have anything in formal writing except the honor system. I do not ever like to burn bridges.

I heard that in California, as long as tenant pays 1 dollar, then you can't evict him or her, because it no longer falls into "no payment" is that true?

How about a landlord going to the hospital when you been admitted for pancreatitis and demanded your rent?

I understand the whole thing about real estate and all the ins and outs, but the reason why I’m not a landlord is because I could never evict anyone that’s facing hardship. I just couldn’t do that.

If they don't pay I just block their cars in the driveway so they can't go to work and make money. And I make signs so the neighbour's know what's going on and embarasss them into leaving. Following the rules takes too long. If you don't pay get ready to be shamed in public until you leave. Worked like a charm everytime. You ain't gettin free rent on my dime, I can tell you that.

I always paid on time, but my landlord would sexually harass me and he would never fix anything. He’s a slum landlord.

Coach, you really missed the boat on this one . When paperwork is filed on a month to month Agreement , the stupidest mistake is to give a REASON for the eviction . Trust me on this . .. if you give a reason then that gives the dead beat LOSER tenant an excuse to screw the landlord around . ...I learned the HARD way not to give a reason other than I'm simply ending the Agreement .IF you give a reason, then the tenant then has a chance to argue the point ( see more below ) , which then gives the tenant more TIME to destroy. the property and live rent free for a few more weeks or months .Heres how it works : LL files the initial paper work, ( another mistake is to have the cops or Process Server deliver the FIVE DAY notice )- which you dont need to have done , because it should ALREADY be in LARGE print in the Agreement if the Notice is ALREADY in the Agreement, then just go ahead and file the eviction. .The LL cant deliver, it has to be anyone over 18 yrs old and a AFFIT signed and notorised after delivery .Tell the Court its been delivered, THEN the cops get around to delivering the Courts Notice to appear ( cops usually take 3 to 7 days to deliver the Notice !!!) which the Court gives the dead beat loser tenant FOURTEEN DAYS to respond . The dead beat LOSER tenant then has 14 days to show up for COURT to respond, and ya know damned well they wont reply until FOURTEEN days later at about 5 minutes before the Court locks the doors...If you give ANY reason other than LL is ending the Agreement, the the Court will allow the dead beat loser tenant TIME to correct .Which mean the LL has to go through this AGAIN ! !...Another thing to do is when you initially go to Court is to SUE the tenant, that way you dont have to track them down after they are gone from your property . RULE # 1 is dont give a reason for eviction!!!! There is another rotten trick the tenant can pull to delay the moving out . Anyone wanna know the trick ? Pay pal me $250 ( A Best Deal Storage -on Google )and I'll tell ya - as I've had tenants do it to me . ( all this info applies to South Carolina ) Good luck !
