No charges after man shoots child’s service dog

Two city animal control ordinances played roles in the shooting death of a service dog in southeast Indianapolis last week. The man who shot the dog wasn't charged due to the dog being found to be in violation of city ordinances.

ADA (which overrules state laws) states that registered service animald legally don't have to be leashed and/or contained.

That man needs to face charges. As for authorities not charging him. I don't give a DAMN what the STATE says.... FEDERAL LAW DICTATES SERVICE ANIMALS DO NOT NEED TO BE LEASHED / CONTAINED / MONITORED.

THIS is very clearly stated by the Americans with Disabilities Act!!!

Was the kid out there also, what about a firing a gun in a public place there must be something to prevent this type of action it doesn't seem right to me, the dog didn't look aggressive it wasn't running at him it . I am so sorry for your loss.

Clyde was NOT A PET! He was a service dog. According to the ADA pet laws do not apply to service dogs.

Nearly 5 year Amazon Flex driver here who firmly believes people need to do a better job of securing their dogs, and even I feel that shooting Clyde with a gun was an extreme response. Halt! Spray or even pepper spray would have stopped the dog far more humanely, and without fatality. Also, was the shooter really in reasonable fear of his safety? Or was this deliberate. As a delivery driver, I avoid addresses where people don't secure their dogs. I don't kill their f**king dogs.

The Americans with Disabilities Act (ADA) does not certify nor set up a registry for service animals. While a search on the internet will provide results of organizations claiming that they will certify or register your animal for a fee, these are not valid under the ADA and only seek to profit from their claims.

At this point the shooter is a threat to everyone. Pity if someone should feel threatened by his very presence.

He wanted to shoot the dog. The dog was still in the yard when he was shot. That old man was on the sidewalk. He didn't try to leave the situation or yell for help. He acted rashly and irresponsibly. The dog wasn't even within arm's reach of him. I don't care if the dog was a service animal or not. There was absolutely no justification for it.

That guy should be charged AT LEAST with discharging a weapon in the city limits. And does he have a permit to carry a concealed weapon ? For God's sake, I'm a diabetic, I do have a license to carry concealed, and I've never pulled a gun on a dog because he wagged his tail and headed, barking, in my direction! In a world of ever-increasing craziness, that's right there among the worst.

You are kind of right service dogs are not pets but they are part the family which makes the crime he committed by shooting and killing the dog even worse he's a dog killer and should go to jail

I'm questioning if Clyde was actually a service dog for a few reasons. First they said he was a "registered" service dog. Registration doesn't exist and has no legal value. And service dogs don't run up to strangers barking. Even if he was off duty, him running at the man barking could be interpreted an an act of aggression and service dogs can't be aggressive.
I'm not saying that this man had a right to shoot the dog, I think that was a bit extreme. But I don't know if Clyde was really a service dog or not...

If that black lab was an on or off duty police dog the guy would be in prison for killing a cop. You can't just kill something just because you perceive everything as a threat, you need to be aware of your surroundings. Letting this guy go Scott free Opens up dangerous precedents.
