PATHLEGAL JUDGEMENTS:FIR UNDER SECTION 498A FILED BEYOND PERIOD OF LIMITATION OF 3 YEARS IS QUASHED

Justice Uday Umesh Lalit and Justice Vineet Saran of the Supreme Court noted that the First Information Report under Section 498A IPC filed by wife three years later, after both separated and the husband had filed a divorce petition, was quashed as it was filed beyond the period of limitation of three years. The Court affirmed the quashing of the FIR under Section 498A IPC by High Court and the court while allowing the appeal, also quashed the FIR under Section 406 IPC.
