PATHLEGAL JUDGEMENTS:CAN SECOND F.I.R. FOR SAME OFFENCE BE REGISTERED?

The Supreme Court bench comprising of Justice N. Santhosh Hegde, Justice S. B. Sinha and Justice A. K. Mathur noted that the High Court did not permit second F.I.R to be lodged. The court upheld the registration of second F.I.R. by the police on the direction of the Magistrate and set aside the judgment of the Additional Sessions Judge and High Court while allowing the appeal.
The case is that the first respondent had lodged an F.I.R. on an incident wherein the complaint, the appellant and a few others were the accused.
