Tow truck driver arrested for booting cars

A Gastonia tow truck owner claimed he was arrested by police because five words on his towing signs had the incorrect font color.

Gastonia Police charged Brandon Abernathy, the owner of Southside Towing, with misdemeanor "improper signage; trespass towing" at a parking lot across the street from the city's new CaroMont Health Park, the baseball stadium at the center of the city's FUSE District.

Abernathy said on May 18, he and his business partner, Marcellus Hardin, who owns Hardin's Affordable Towing, were booting the cars of people who parked at the Save-a-Lot grocery store but didn't go into the store.

Instead, Abernathy said the people were going to the ballpark.

If the sign isn't clearly and legally erected it's the property owner and tow truck owners responsibility to ensure that it is, plain and simple. SO DO YOUR JOB PROPERLY, HONESTLY, OPENLY AND LEGALLY AND STOP COMPLAINING ABOUT YOUR IGNORANCE OF THE LAW. As Judges routinely tell the police officers, the plaintiffs and defendants, "ignorance of the law is no excuse for violating it when you make zero effort to ask before breaking the law".

Being arrested over five words on a sign having the incorrect color is awfully harsh and vindictive. It should be classed as a city code violation. Those are normally dealt with by paying a fine and fixing the problem. Of course, there is some irony in the fact that a tow truck driver who enforces the _letter_ of the law against illegally parked cars himself becomes a victim of the _letter_ of the law.

The ballpark sounds like they are horrible to have in that community they dont care about anything about their fans they care about money and if the fans cars who illegally park get towed they wont keep coming to the ballpark

Im glad.he got arrested.. lol... now he complains that no one told him about the regulation.. is no ones job but his own to be informed about the regulation ..thats why u open the bussiness because u read the rules ... just the way he tow cars .. he doesn’t inform the car owners about the towing sign, he just towsed he vehicles.
