(b) Compensation cases —

(1) Scheduling reexaminations. Assignment of a prestabilization rating requires reexamination within the second 6 months period following separation from service. Following initial Department of Veterans Affairs examination, or any scheduled future or other examination, reexamination, if in order, will be scheduled within not less than 2 years nor more than 5 years within the judgment of the rating board, unless another time period is elsewhere specified.

(2) No periodic future examinations will be requested. In service-connected cases, no periodic reexamination will be scheduled:

(i) When the disability is established as static;

(ii) When the findings and symptoms are shown by examinations scheduled in paragraph (b)(2)(i) of this section or other examinations and hospital reports to have persisted without material improvement for a period of 5 years or more;

(iii) Where the disability from disease is permanent in character and of such nature that there is no likelihood of improvement;

(iv) In cases of veterans over 55 years of age, except under unusual circumstances;

(v) When the rating is a prescribed scheduled minimum rating; or

(vi) Where a combined disability evaluation would not be affected if the future examination should result in reduced evaluation for one or more conditions.

How to Get Your VA C-File
Veterans can obtain their C-Files by requesting a copy from their local VA Regional Office. Usually, veterans must submit VA Form 3288, Request for and Consent to Release of Information from Individual Records.

My decision letter has no mention of static or not….i called my rep and they act like they had no idea what I was talking about 🤷🏻‍♂️. I ordered my c file. I’m 55 or older group

VA fought me 11 yrs and then I got a lawyer and in less than a yr I went from 70% total rating with 40% direct connected to 100% P&T. The lawyers re filed everything I had and more for the VA to review and when they looked at the actual rating on me and putting my back secondary to my knee kind of BS, I am now 130% direct connected and 130% secondary connected and still going up, even though rated 100% P&T already. I'd hope mine was protected after being crapped on for 11 yrs, I just wish I would have kept up on appeals so I could have gotten that 12 yrs of back pay instead of just 11 months, but I made the hundo club and that was the point of it all. You'll figure out what 12 yrs of back pay would total with an increase of $2, 000 per month...yes that's 6 figures I missed out on by not keeping up on my appeals alone, learn from $288, 000 loss people.

I'm at 70% . Butt have nerve damage in my neck and back. 4 blown disk. Turn it all the paperwork, mri, x-rays. Still haven't heard anything for a year.

Not true, in my case... over 55 here. I was static at 40% for my lower back.. i had some claims deferred which was radiculopathy. The VA sent me for another CP exam for my back for an increase, i did not ask for an increase, neither did my attorney. I kept that rating of 40% for 8 months, reduced to 20%. My back is so severe, along with my radiculopathy in my legs; im in a mobility scooter...i go to my regular medical appointments, which is well-documented, I have severe back issues
