Disability insurance attorneys Gregory Dell and Stephen Jessup discuss the challenges faced with short and long term disability claims resulting from chronic fatigue syndrome.

Although chronic fatigue syndrome is a real and difficult condition for the person suffering with it, it is subjective in nature, meaning there are no diagnostic tests that can pinpoint a diagnosis of chronic fatigue syndrome. As a result, disability insurance companies will take advantage and commonly deny these claims on the basis that the claimant was not able to provide any objective medical evidence to support their disability as a result of this condition.

Many disability insurance policies are written with 24 month limitations for receiving benefits for this condition due to the fact that it is based only on subjective complaints.

Often a claimant will undergo extensive testing, such as bloodwork, MRIs or brain studies, which will come back negative. And after the physician rules out all other possible causes, will then diagnose chronic fatigue syndrome. Disability insurance companies also try to pawn off they symptoms of chronic fatigue syndrome as resulting from a somatic or psychological disorder, such as depression.

It is important that your treating physician document your symptoms in the context of chronic fatigue syndrome, and it is even helpful to keep a journal documenting your symptoms and how they limit and restrict you from performing your job.

These tests cannot be faked and with enough funding and publicity, will become standard diagnostic tools in the future for both research protocols and disability cases. Numerous disability cases have been won from these tests. Unfortunately, they are only offered at these two locations, making it difficult for the most informed to participate.

Although, I am a fan of your videos, your statement regarding testing for CFS is untrue. Both the Workwell Foundation in Northern CA and Betsy Keller at Ithaca College offer 2 day CPET testing that objectively demonstrates Post Exertional Malaise (PEM), the hallmark symptom of CFS, compromised VO2 Max levels, as well as exercise-related neurally mediated hypotension.

I've worked in IT for 30 years in front of screens 8+ hours a day, 10y in the current employer (currently 55yo) and in the last year i've had to increase magnification three times from 1.0, to 2.0 to 2.5 to work. I am now useless without my glasses. The morning starts out fine, but after 2 hours, i can't be online for more than 30 minutes before getting a headache. Even after breaking away i sometimes feel nausea especially in the afternoon. Most days driving home I can't even focus. My employer allows me to work from home some days and honestly I'm barely working anywhere what i use to. I'm worried about it and about to see a doctor for the first time about this. What kind of doctor can i see and if this gets worse, what is my best course of action with my employer and LTD provider? I am not sure i want to tell anybody at work yet or how they will react.. It's a very competitive, cut-throat workplace and ive seen them push out older staffers with eager interns. How can I protect myself?

Regarding LTD, how much medical history do I need as I currently have zero medical history on this?

Will provider care about sick days I've taken or conversations I've had with my employer?

Are most of these cases declined and require a Lawyer and back payments? I feel i could weather a few years but after that I'm in trouble.

any suggestions are welcome.

I have a positive test for Epstein Barr, diagnosed with Mono 3 months ago, and again today. My doctor told me that is DEFINITELY Chronic Fatigue Syndrome. I also have Fibromyalgia and Interstitial Cystitis which are both autoimmune disorders. My tests are objective, not subjective.

now the cause of Chronic Fatigue Syndrome  is found: radiation of microwaveoven.(magnetron)
To stop you have to eliminate the oven out of the house.
The plug out of electricity net because the oven has also radiation when it is not in use.And out of the house because the oven has a high voltage capacitor.
The distance between an oven and a person is very important. After a 2 weeks without microwaves health becomes better.
