I love how there only showing him when there were two other men involved. I don’t think Penny should go to jail he and other men were trying to get a crazy person under control. The last time something like this happen nobody helped. It was a crazy man who grabbed a woman by the hair and nothing happen. NY should be ashamed for not doing something about the rampant crime, drug addicts, and mentally ill loose leaving citizens to take matters into their own hands since the police are so scrutinized. That is a difficult case. Without knowing the man was mentally ill he appeared a threat. This guy was attempting to keep him from hurting anyone yet he needed to know that in getting involved he had to be careful of his actions.
Regardless of that individual appearing to be a threat his life was still a life that no one has the right to eliminate. He did cause the homeless man's death and for that he must pay. Did he do it intentionaly? That's what needs to be discovered in this trial. I believe he did not say to himself "Here is an induvidyal that I can and want to kill" he truly believed that person was a threat and wanted to protect others. Unfortunately, the man did die at his hands. This should probably be an unvolentary manslaughter. The max is 4 years but the juge or DA can recommend less even up to a monitor bracelete.
