Here in Australia it is mandatory for any fatal accident that the driver is taken to hospital and have their blood taken to test for drugs and alcohol. She should have been tested even if she wasn’t showing signs of intoxication

When you sign for your NJ drivers license, one of the conditions is you are authorizing the state to test your blood/breath/hair/urine if you’re involved in a serious motor vehicle accident to determine if drugs/alcohol is a factor. The accident IS the probable cause.

In Australia, no probably cause, nothing, if you get in an accident and the police are called, you get tested. No ifs or buts, you have to be tested. We don't protect drink drivers here and we love that. We feel so much safer on our roads.
