In my baby barrister days I represented a chap up for "drunk and incapable"; but he was really annoyed about that and wanted to be charged with "drunk and disorderly" on the ground he could handle his beer but just liked a scrap.

Staff can refuse to serve someone for appearing to be drunk. Old as the hills that one.

I think it's more about how people behave whilst drinking, rather than being drunk. Technically, if drink driving limits are the gauge for being officially drunk, you're drunk after a couple of pints.

Britain is far from a free country. Almost every video from this channel informs me about almost every aspect of life and action being illegal. When a state makes illegal almost everything, then the concept misses the point and instead of complying with totality one prefers to revolt against it.

From the road… I think I prefer the US. In most US states it seems they use the phrase “drunk and disorderly” in law. A long time ago a good friend had a polite encounter with local law enforcement, in Texas. He was wobbling back to his hotel when stopped. At some point in the conversation, the officer asked my friend if he was aware that it is illegal, in the city of Plano, to be drunk and disorderly, to which my friend replied “Ocifer, I’m drunk but I’m not disorderly”. There was no malice in the officers my friend encountered and they gave him a lift back to his hotel!

Apart from being asleep in bed alone in one's own house, dreaming of a better place, is there any aspect of human life, any activity, that isn't subject to some law or other. Without being subject to any "ifs, " any "buts, " or "it's not quite as simple as thats" ?

well im screwed then as i 'break the law' every time i go to a pub. i NEVER come home sober! the local pubs dont seem too bothered as long as theres no trouble caused!

The majority of publicans I have observed would sell alcohol to anyone well over the limit ie drunk, as long as they could increase the takings. I used to go to a pub regularly and in one case the barman continued to sell large whiskeys to a regular, knowing that he would then drive home. He was staggering along to his car later. I reminded the barman that he could be held responsible if there was an accident - he said it was up to the customer!

One has to ask….How incompetent are successive Governments which allow such archaic and out moded laws to remain extant. I have said it before…our laws are in drastic need of bringing upto date. Imposing hundred plus year old laws on common and accepted custom is frankly unforgivable….We PAY for Government to run the country for us…right! So instead of just Yahoo’ing across the House, they should be applying their spare time to revising out of date legislation such as this!

*I was a licensee for a number of years, it's illegal to serve anyone who is drunk in a pub, being drunk is subjective, being drunk & incapable is generally when you're liable to Police interest* 🤫

How is "drunk" defined though? Is it down to your blood alcohol level or how you are behaving or both? I mean you can be over the blood alcohol limit for driving and yet not stumbling around, still perfectly well behaved, no bother to anyone, not what most people would call 'drunk'. If it's purely judged on blood alcohol levels then a large proportion of pub goers and 100% of pubs break the law every day they open!
