I was a juror for two weeks on a shooting outside a local club and the thing that astounded me the most was how every single witness had a vastly different recollection of the events from every other witness!

So the judge is eliminating jurors who would fail to convict based solely on one eye witness? That's wrong. The judge should not be allowed to ask questions like that.

My mom served on a jury in Idaho back in the 1980's. A farmer bought an irrigation system to upgrade his farm, and it didn't work. He hadn't kept the old one. The other jurors thought the farmer deserved to lose the case. Mom asked them if they keep their old car when they get a new one just in case the new car doesn't work. They said no. That argument was enough for the jurors to see what idiots they were. Farmer won the case, but my mom was disgusted at the lack of intelligence of her fellow jurors.

When I was in police school, our instructor did an experiment. While in class one day, he had a person run into te room, grab an object off of his desk at the front of the room and run out. Right after that, he told us to describe the man, and identify what was taken. Which was an apple.

There were 10 people in the class, and he got 10 different descriptions of the person, in clothing, height, race, hair and so on. No one ever got the entire description correct.All of us had parts of the description, but no one had the complete description. It was after that demonstration that I started to disbelieve eyewitness. I would need other evidence to convict. Especially if it were a death case. I would never send someone to death, or to life on eyewitness testimony alone. Neil is correct.

Frankly, the Judge shouldn't be allowed to favorably stack the jury by asking such a prejudicial question. If the case is so weak, that only single witness testimony is available, it should be kicked back to the prosecutors office for re-evaluation.

I sat in jury trials for 15 years covering them as a news reporter. I can’t tell you how many times I was surprised by guilty verdicts on very little evidence, particularly eyewitness testimony. When I spoke with bailiffs, who were the only ones to go in and out of the jury rooms during deliberation other than jurors, I was shocked to hear that some juries didn’t spend ANY time going over the evidence. They’d come to a consensus vote right away and then sit in the room for however long they thought “looked good”. We’re talking murder trials here with 20-life sentences on the table.

I took sociology freshman year. One day a guy ran into the room and stole our professor's purse. She told everyone to stop and write down a description of what we just saw. In a class of almost 200 not even two people described the "thief" in the same generic description. Completely changed my mind about eyewitness testimony.

A lawyer was telling me once that they never want to choose a person with any sort of high level credentials for juries, engineers, doctors, etc, because the other jurors will basically look to that one person for answers and not think for themselves.

I was a juror in a malpractice. I'm an electronics technician. I had no idea what they were talking about. Thank god there were 2 nurses that were jurors too. They explained it better than the lawyers.
