If you intend instituting a claim in the Small Claims Court, ensure that the opposing party is able to compensate you should the judgment be in your favour. It is futile to institute a claim against another person who is unemployed and who possesses no property.

What if you don’t have the person’s physical address or email, but you were in contact with the person via WhatsApp. Would a letter of demand sent via WhatsApp be admissible?

In a case where i dont have car insurance. I bumped into someone that has insurance, i told them to clam from their insurance which the access was R8000, which i was willing to pay but then they say want to do it privately which would cost 20000. Since i dont have that kinda money available, am i able to take this up with small claims court
