Modernising the Tort of Wilkinson v Downton| Part A Tort 2024

This Lecture is designed to assist in your preparation for answering the exam questions which will be posed about the article in the compulsory Part A of the Tort exam.
It will give context and detail to the legal issues involved and provide guidance in following Mulheron’s line of argument, as well as simplifying some of the more unfamiliar or taxing aspects of the article.
The tort in Wilkinson v Downton (1897) has long been a problematic one to both teach and study. This is because it doesn’t fit neatly into any other category of torts, although it has strong similarities to some. There is ‘obscurity’ and uncertainty’. Also, actions under Wilkinson are very rarely successful, as the article discusses. However it endures, and has spread to the four corners of the globe. Claimants and their lawyers continue to employ it in litigation, for instance notably in 2015 in Rhodes v OPO, although it must be noted that this was yet another example of a failed attempt.

very great argument you raised about the practicality of DSM-V, the claimant no doubt can exaggerate the outcome of statement by simply claiming i had been sleeping peacefully my whole life, but about this statement my nights are ruined, courts will demand evidence which will cause the whole claim to be unsuccessful, it wouldnt be wise accessing DSM-V as an determining factor for proving sleepless nights or all-day fatigue because of defendant statement.
