⭕ How Do I Evict A Tenant? (Section 8 Notice to Quit)

It’s ugly but sometimes landlords have to evict a tenant. In the UK there are very set rules to doing this.

For evicting a tenant in the UK you have to either issue a section 8 notice to quit or a section 21 eviction notice. You can do this yourself but we recommend using a solicitor.
Section 21 Notice
So what is a section 21? It's part of the section 21 housing act 1988. You must give at least 2 months notice in writing if you are using Section 21 eviction notice. This is a notice that can be given when the tenancy agreement has expired.
A section 8 notice to quit is also known as a section 8 housing eviction notice. It is a notice, served by a landlord when evicting a tenant. It used when a landlord wishes to regain possession their property when an Assured Shorthold Tenancy agreement is in place and there has been a breach of contract between the landlord and the tenant.
So yes, you need a 8 notice to quit and section 21 eviction notice for evicting a tenant in the UK.

If you don’t live in the UK but own a UK property (or otherwise) we would strongly advise that you use a solicitor. You can do it all yourself but a solicitor will be faster and more efficient. If the tenant isn’t paying rent or is causing damage to the property or is displaying anti-social behaviour then you need to evict them quickly. To not do is going to be costing you more money.
So a solicitor might be expensive but it may be more expensive for you as a landlord if the process doesn’t happen quickly. If you make a mistake on the forms (the section 8 eviction forms and the section 21 notice) then you are going to create delays.
But there is another option. We are members of the National Landlords Association. It’s a paid for membership but in our experience, they offer great advice. If you join the National Landlords Association then they have a phone number you can call where someone will talk you through the process.
And of course, the letting agent or estate agent you are using should be able to offer you lots of advice as well.
