Difference between Workers’ Comp, LHWCA and the Jones Act Law
Показать описание
There's a significant difference in the type of benefits that you're eligible for, depending on the type of work that you do when you're working offshore. Land-based employees oftentimes fall under state law, whether it's Texas law or Louisiana law. Folks that work on vessels are typically fallen or what's called the Jones Act, that is if you work on a vessel and you're assigned to the vessel and you contribute to the function of vessel, you're entitled to what's called Maintenance and Cure. Finally, the third major category are Longshoremen who fall into the Longshore Harbor Workers Compensation Act. If you've suffered an offshore injury, determining which status you have -- Longshoremen, Jones Act, or otherwise -- can make a significant difference in the type of benefits in the case that you have. Please call us if you have questions about the type of benefit you're entitled to.
The Longshore and Harbor Workers’ Compensation Act (LHWCA) provides certain maritime and non-maritime workers the right to pursue compensation for on the job injuries. Similar to other workers’ compensation programs, the act gives the absolute right to workers to receive benefits in case of workplace injury. No matter who was at fault for the injuries, if covered by the act the employee is entitled to benefits.
