Thank you so much for making video on this issue facing by millions of youth in job sectors. Nowadays every big and small companies making fool to employee by forcing them to resign just after completing their 4.5 yeas, just to snatch their gratuity amount.

Government should enforce strict law against these types of fraud being done by these types of companies. More strict law is required for this issue.

Maternity benefits bhi kaafi saare jagah pe nahi milti hai khas karke semi aur un-organised sections me.

Technically, employees lawyers afford nahi kar sakte hai aur apna desh ka labour laws itna streamlined nahi hai toh jitne benefits ek employee deserve karta hai usko utna nahi milta hai.

We need a detailed video on this. There are a lot of things that still need to be explained like the applicability of law, what to do if the employer refuses to give gratuity, etc.

1. Is it true that if I have a 5 day work week, the gratuity kicks in at 4 years and 190 days of continuous service? I work in head office and we have a 5 day work week.
2. My notice period is of 90 days, and it would lead me to complete 190 days in 5th year if I serve the full notice period.
Is notice period considered in as the employment period for gratuity eligibility?
3. Assuming answer to both the question is 'YES'. Can my employer legally ask me to leave early so that they dont have to pay me gratuity?

I faced this in TCS, I was ready to serve extra days notice period and wait to complete my remaining days, but I was told I need to be in office for 2 more months after serving the gratuity eligibility period.

You have said in the organisation where gratuity act applies but in some case gratuity act doesn't apply there also gratuity can be given and it is calculated in different ways.
