What is a Military Spouse Entitled to in a Divorce?

A military spouse can be entitled to lifetime health insurance through Tricare. A military spouse can be entitled to continue having a base ID card and PX privileges. Those two cannot be negotiated in a divorce case. It either is or is not applicable under the federal law if the 20-20-20 rule is met.

As well, under military rules, a service member has an obligation to continue supporting their spouse and their family. In court cases, there might be a big gap from when you file and when orders are entered. To cover that gap, a divorce attorney can contact the command of the service member and have payments be ongoing even in the absence of a court order.

The most important issue at hand is the military pension. As the spouse of a service member, you're entitled to a share of the military pension. That's going to be a function of how long you were married and how long the service member was in the service.

I bought my ex out of my pension for a fraction of what she could have collected over a lifetime. Totally worth the upfront cost and I’m not tied to her for the rest of my life. 🤷🏻‍♂️

A Military 'Spouse' is entitled only to what the divorce decree states - sometimes NOTHING if you are very smart.

What happens if you have been married for 40 years?
Retired and wife has a illness that is life threatening. Has the the payment already there for the the retirement payment in case of death, also what about social security since he is close to that? What about the fact he has admitted to paying for prostitution.
He spoke to a lawyer and decided that it was cheaper to stay married.
No young children anymore but still have a grandson that lives at our home. Yes wife worked through marriage while active duty. Traveled and moved during all those 30 years.
Worked when she could have care for children never relied on her family.
Never lived near family.
Now at the age of 60. He decided she was not good enough.
Right before pandemic he was seeking other women. While wife was immune suppress due to a muscle disease that also affected her lungs. During that time he engaged in sex with other women even pmrostitudes he found online. While putting her at risk for Covid.

The correct answer is nothing. They don’t deploy, have to get up early and do PT, work 12-15 hours a day, and can be a 304. Military members are US government property. How can they sign a contract with a civilian without JAG or their commander reviewing the contract and without disclosure of civilian and UCMJ laws at the time of signing the contract. This makes the contract void.
