As a patent attorney, this episode of suits made me want to put my head through a wall. One quick note, you made a comment about the first to file system adopted in the U.S. post-AIA. It’s actually the opposite - the first to file system did away with the prior first to invent system which looked at the earliest date of reduction to practices of the invention.

But I also agree with you that the threat to make the plans public is complete BS, especially considering the patent system REQUIRES that you teach a POSA how to make and use the invention.

Great video. Something also to keep in mind is that getting a patent is a very, very, very long process; he couldn’t have gotten it within the timeframe of the show and he should’ve started that process several months if not years before approaching an attorney in the first place.

Well Suits is fiction, however I believe in real life there are lawyers like Harvey amd Zane, and Pearson.
Thay are make themselves fortunes and are not lawyering Suits.
