By the way, this is actually a concept in Jewish law, "there is no agency for sin". In spite of that, practical considerations (such as the history of pogroms) may require overriding the concept.

The video included a mistake. Libel was likened to the "incitement" example, where it presumes that people are required to exercise responsibility (ie. he told him to perform the crime so it's his fault etc), when it should have been likened to the "fire in the theater" example, since they are different to the "incitement" example in that the audience has no reason to know that the statement is false, and must err on the side of caution .

I disagree with the part about conspiracy: If the conspiracy is to commit a crime, for example planning a bank robbery, murder or terrorist act, then this should not be protected by free speech, since the intent of the participants is to do harm, regardless of whether the crime is actually committed.

Sorry - I disagree strongly with his claim that there is a difference between accessory and incitement. His nice theoretical idistinction was no comfort to the hundreds of thousand Jewish pogrom victims over the past 2000 years. The women who had her belly sliced open and the baby thrown out the window probably had a hard time doing so also.
