Being prosecuted in absentia... Great... So the defendant isn't required to be at his own trial? I can imagine one day answering a knock at my door and being greeted by a posse of sheriffs telling me I've been convicted of some crime that I wasn't even aware I was accused of. Sounds great.

When congress wages war on another government that offers competition to its monopoly in the market, then you will be compelled to go and fight.

Since Rothbard also supports the idea of private court system, subpoena and jury duty are not necessarily in conflict with his version of free society. For example: If I subscribe (voluntarily of course) to a particular private court system or live in an area where all land owners subscribe to it and that system has subpoena and jury duty written in law, then that court CAN force me to fulfill such contractual obligations and it would not be involuntary servitude per se.

Offer this everyday you serve on a Jury voluntarily your taxable income is reduced by 1%. Or pay jury members the equivalent of an E1 in the army

How dare he be intellectually consistant? Even if history has shown that liberty and non-coersion are the best ways to ensure the optimal benefit to all, we should base our system on cognitive dissonance and make as many exceptions that swallow the rules as possible!

Liberty in itself is not the highest morality. Applying Liberty as the highest thing to achieve would lead to Anarchy or at least situations where the optimum societal outcome is not achieved. I am saying that in the video Rothbard applies Liberty as it in itself is the highest goal.

I think there is no reference to there being a victim. If someone is raped then their life or liberty is infringed, at which point they have the right to defend their life/liberty with force. If someone is being tried for drug possession then there is no victim to defend. Though the accused is made aware that he has the chance to represent or defend himself from that which he is accused. Voluntary action though so he does not have to show up, but will still be tried.

Sure fire way to get out of jury duty: during screening process state you will demand the judge give all the jurors the knowledge of their power including explaining jury nullification in detail and/or during screening explain to the attorneys that if there is no victim, there is no crime and you will not put any free individual into the prison slave labor gullage system.

Hmm..some interesting points. I agree about the slave-jury system but others than that, I think Rothbard has gone a little too far in his thought. I agree freedom and non-coercion are good principles but there can sometimes be exceptions to rules. I don't think the goal of a society should simply be liberty and non- coheresion, but the optimal benefit to society as a whole. Life and the pursuit of happiness as well as liberty.

not sure at all if srs. Under libertarian principles when force is used against you that's when it's fair to use force back.

The second half. Police shouldn't be going into most if any situation with intentions of shooting to kill, even a murderer, when they do you get what you got with that rogue cop in California, a lot of innocent people with cop bullets whizzing by their heads. Kill and ask questions later, isn't a good way to go about things. Seems like the criminal's way to me.
