Lawyer here. Court is not going to “force” Bernie to carry out his executor’s duties. Court is going to replace him and appoint a new executor or administrator of the will. It will be out of Bernie’s hands. Why they waited over 4 years to make a court application is beyond comprehension.

Another problem could be if mom became a ward of the state and on Medicaid while in the nursing home. Medicaid could have a lien against the house that must be negotiated and satisfied before the house can be sold. Family can physically have control of home but must settle any liens before they can sell.

My inlaws are this guy and his family only her cousin is now living in the house and the grandparents died about 25yrs ago..theres still no lawyer involved..prob because all the estate went to paying taxes, maintenance and power Bill's for 20yrs of this house sitting empty.

I wish Dave had explained what it meant to be the executor on a house with liens. My younger brother was the executor on the house my father left for the two of us. It does sound like "Bernie" did not execute, but his job is a little more complicated than you see on tv. You need to take care of ALL depts owed BEFORE anyone can receive proceeds from the sale of the house.
