If you kill someone while sleepwalking, are you guilty of murder? We explain the basic things/elements which have to be present for someone to have committed a crime and what the difference is between a crime and an attempted crime.

You'll even understand what legally sufficient act (actus reus) and a "guilty mind" (mens rea) mean. This is a basic overview of the law, not legal advice.

Actus Reus means "guilty act." It describes the action or act that is illegal. For example the actus reus for assault is " causing physical injury to another person."

Mens rea means "guilty mind." It describes our mental state, or how we choose to perform our action. There are four mens rea: intentionally, knowingly, recklessly, negligently. The law will assign a mens rea to every crime.

This is misleading. Mens Rhea is not state of mind but rather element of intent. In statutes these elements are articulated with words like knowingly, intentionally, maliciously, with malice aforethought, etc. Some crimes can also have specific intent- such as theft requiring the specific intent to deprive the owner of property. The exception is the strict liabillity statute where an action is always illegal no matter whether a person has a guilty mind or not. It is also possible to form mens rhea instantly.

Here is the three street rules or criminal code or rules that should be in everyones book or list,
Rule one: do the crime by yourself.
Rule two: never tell anyone about your crime.
Rule three: stick to your Story.

I want to start following the law better. Sometimes I feel like some of the laws are obvious, but it's good to read up on them because you never know when you are going to slip up and do something stupid.

I wish they had a guidebook for people to know how to follow the law and it's not just a hearsay type thing. What are you guys recommending give people to basically know all the laws they will reasonably need to know?

I mean it's basically baked in my conscience not to do dumb things that hurt people, but I wish it was just more clearly laid out for people who didn't have that conscience.

I'm lucky that I have a conscience. Some people don't have that luxury.
