Under the Indian constitution, a seat held by a Member of Parliament (MP) can become vacant in the following ways:

1. Resignation: If an MP resigns from their seat by writing to the Speaker of the Lok Sabha (for Lok Sabha MPs) or the Chairman of the Rajya Sabha (for Rajya Sabha MPs).

2. Double Membership: If an MP is elected to both Houses of Parliament or to a House and a State Legislature simultaneously, they must vacate one of the seats within a specified period.

3. Disqualification: An MP can be disqualified from holding their seat if they violate certain constitutional provisions, such as holding an office of profit under the government, being of unsound mind, or becoming an undischarged insolvent.

4. Absence: If an MP is absent from all sittings of the House for 60 days without prior permission.

5. Death: If the sitting MP passes away
