Can I File a Petition to Get Child Custody Back?

The short answer is yes, you can certainly ask, but the longer answer hits on two themes. You’re not gonna get anything in life or in Child Custody that you don’t ask for.

The second theme is that whatever you are not taking control of, in life or in Child Custody, somebody else will. So what are you exerting agency in? Are you controlling what you can or letting someone else’s thoughts, feelings and behavior control what you do for yourself and your children?

There’s much more to it than just filing a petition.. So I’ll just tell my story. I was going thru a tough time last summer (2019) stressed to the max over job, bills, money the whole nine yards.. my sons dad wouldn’t help me out at all with him.. October 2019 comes around and my mom files a petition to take over my role as a mother for my son while I got somethings straightened out to ultimately be able to provide my son the best life I could. During that time I started going to counseling, got on anxiety medication, decided to get a less stressful job, I moved out of my home and in with my current boyfriend(which is apparently a big red flag to judges) April 2020 comes around and I decide to file a petition to get my son back and it has been nothing but a shit show since. My mom has been doing everything in her power to not let me have my son back... so I decided to hire a lawyer in June 2020. It’s been a rollercoaster to say the least but I can tell you here it is October 2020 and I still haven’t got him back. We’ve gone to court so many times and each time it’s just something else. It’s a very stressful situation to be in.

A California Judge will not let me Intervene on the case. I am the Indian Custodian. (ICWA) Indian Child Welfare Act allows me to have a Court Appointed Counsel if I can't afford one, I should be Included onn the case plan. The Court Clerks will not accept my documents to be filed with the courts. The courts are moving forward and beteween the County and ICWA there are 27 Violations when I researched (CPS) The Courts are ignoring there own rules Congress, and State and Legislature.

My sister had her children taken away. Her ex husband is wealthy and she is not. He has been trying take the kids for several years and finally got them by claiming my sister was abusing them. My wife just lost Primary residential custody… for no reason … neither her or I have a record … but the children’s father and step mother do … and the judge made the decision to allow my wife’s son to live with their father… without any reason to try to fight … we are going to appeal … but the judge leaned towards his and my wife filed the paperwork for him to see his kids … and now they are gone 8 hours away. ☹️😢

I have had a case thru DCFS, they closed my case out because I had to serve a year in jail, i couldnt do the process the courts asked me to do because I was in jail, they closed my reunification rights when I was in jail, the day i got out, I told them I was on track, clean, and in treatment. They closed my case right when i got out of jail (cause they closed reunification while I was in jail). They adopted my kids to my aunt and uncle who don't let me see my kids or talk to them. How do i go about getting them back? Theres no new evidence to refile because like I said, i couldnt do anything cause i was in state custody. My criminal judge said if I was allowed reunification with my kids, they would let me out of jail, but dcfs denied the courts request because they didnt think it was right that I got out of jail early because of my kids. They felt I was using my kids as a get out of free jail card after serving 7 months at the time of request, my lawyef wanted to get me out before they closed reunification so that I didnt lose my kids. Ive been doing everything the criminal courts have asked me to do. Treatment, UA, therapy. I have been sober so that if there is a chance i can get my kids back, im ready for whatever they ask of me. Please help me with some guidance to get my kids back. Reason i lost them is because the police didnt allow me to call family to pick them up while I was getting arrested. My daughter was with me when I got pulled over and i lied to the police saying I didnt know where my husband was who had a warrant for his arrest. They charged me with obstruction of justice and booked me and took my kids to a foster home. Thats how my case was opened.

Ok. I have a different situation to get information on. What it there is evidence of a judge, 3 lawyers, 3 mental health therapists, DSS, and law enforcement acted unethically and in some areas illegally and the child was taken? The child even tells the therapist that they are not afraid or in danger or anything like that. The child also says that "I wish I could be with you always" as he hugs his dad and cries. Again there is evidence consisting on video, picture, and paperwork.
