Hoan Ton-That's app, Clearview AI, has triggered fears about facial recognition — and the dystopian future it could foreshadow. CNN Business' Donie O'Sullivan sits down with the CEO to talk about questions of legality, privacy, and bias in the era of facial recognition.

Clearview AI’s app uses a database of billions of images that the company scraped off the Internet without user consent. Hoan Ton-That defends this. He claims he has a First Amendment right to use publicly available images. Tech companies, though, don’t agree. Twitter, Google, and other tech giants have sent cease and desist letters to Clearview AI. Apple has even banned the app from its App Store. Lawmakers, too, have concerns about Clearview AI.

Did you see how fast this guy jumped from "did you post it publicly ?" to "therefore I can sell your photos and put them on crime databases so police can look you up preemptively for any reason they like" ? And do you really think this practice stops at "crimes" ?

Nothing about it is private. Think about it. Our constitution says that anyone can video record or take pictures of anyone in public without their permission. That being said, it's not required to get permission to retrieve anything public.

In the EU this is illegal on so many levels, but however now that it exists and is profitable in the US, it will likely never vanish from the US..

My question is.... these companies are making huge profits, millions from something they get FREE . I want to know where they are contracted with individuals to make a profit from their personal information and identity. CNN should be asking these kinds of questions because that's where the companies and industry will be put out of business. They wouldn'e EXIST if it weren't for the individual identities and unique features of each person. Either PAY PEOPLE their due or get sued

I don't their methods are GDPR complaint at all. In GDPR, you must have consent, not just refering to as public. More concerning is, it has not respected change of restriction of the photo.
Remember, all of this data was retrieved using a single image of my face. I’ve never been arrested or convicted of a crime. Clearview gathered my data without my knowledge, and without any justification or probable cause.

They’ve likely done the same for you. If they have — and you’re a resident of California or a citizen of the EU — the company is legally obligated to give you your profile, too.


Follow any instructions you receive. Expect your request to take up to two months to process. Be persistent in following up. And remember that once you receive your data, you have the option to demand that Clearview delete it or amend it if you’d like them to do so.
