A friend of mine (in the UK) hit a motorcyclist who was undertaking her when she turned. She willingly admits it was her fault, and intended to do the right thing. But when the police investigated, it turned out he was illegally in the country and he vanished! She still tells the story; she feels doubly bad as she knocked him off is bike, and into hiding!

Does the same apply for crimes comitted by tourists? Would they be sued in US or turned over to home country to face their local legal system.

Yes, the US declaration of independence (nor constitution, corrected) says 'all men are born with equal and inalienable rights'.

Civilians have civil liberties that undocumented migrants don't but all humans have certain intrinsic rights according to the US Constitution.

I have a question about undocumented workers. A few years ago, my employer hired a female illegally and was paying her under the table.

She was then being constantly sexually harrassed by one of the managers. I told her she needed to sue.

She didn't sue because 1. She didn't know she could as a foreigner. (I told her she still could) but 2. She didn't want anything "jeopardizing" her or her fiancé chances of receiving their green card and residency.

Basically her fiancé won the visa lottery and was able to come to the USA. She came to visit him and stayed (but found employment) until her tourist visa expired. She went back home.

They did get married and officially moved to the USA for the long term.

So my question is, if she did decide to sue, would that act bring "unwanted" federal investigations (because she was working as an undocumented foreigner) and would it actually put her future immigration in some kind of jeopardy?

I know it would for the employer, but what would happen to the employee?

Not just the citizens. Not just the people you are ok with being here. Everyone in this country.

Our constitution doesnt just apply to citizens. It applies to all humanity. "ALL created equal"

This doesn't happen all of the time but some cases offer asylum. If you are illegal and a witness to a severe crime this could be your ticket to citizenship

Nice nod to the 2nd Amendment. The Constitution is about what Government can’t do and what it is required to do to and for citizens. It’s the means by which we prevent tyranny.
