The International Criminal Court is fast-tracking an investigation into possible war crimes inflicted by Russian forces in Ukraine.

Russian President Vladimir Putin has continued to deny that his forces are targeting cities and civilians.

But after receiving requests from 39 countries, including Canada, an advance team has now left the Hague for the Ukraine region to begin their investigation.

Global National's Dawna Friesen speaks with former United Nations prosecutor Payam Akhavan on what the probe will be looking for, and whether Russian leaders can be held accountable.

Well if the U.S hasn't been brought up on war crime charges then I doubt Russia will be.

According to the definition, "inability to distinguish between the military and civilian population" is a war crime. USA collateral damage in Iraq and Afghanistan, the most recent one, an airstrike in Kabul, Aug. 2022 and all that drone attacks in Pakistan fall under war crimes. Where does Canada stand as a US ally in the mid-2000 and till the end of Canada's involvement in Kandahar, exchanging intelligence and providing material support to the US that has been causing thousands of civilian deaths in Afghanistan and Pakistan? Does it fall under the war crimes, assisting a third country or being part of a coalition that has caused significant destruction and deaths of non-combatants? Accomplice to crime is also a crime.

The same threshold for what constitutes a war crime must be held as an international rule. This would allow the Canadian Air Force to be charged at the I.C.C. for war crimes for their actions in Raqqa, Syria.

Why does it matter? Courts are only meaningful if subsequent punishments can be enforced. Which, in this case, they can't.

both Russia and the USA are not signatories of the ICC courts on human rights. And such their citizens are not subject to the jurisdiction of the court.
Just to let you guys know.
Russia was never a signatory to the international agreement.
USA withdrew from the agreement ICC agreement right before the Iraq war, and therefore not subject to war crimes and crimes against humanity.
