They have to remove the death penalty charge its complicated putting people in position to choose rather a person die without overwhelming clear evidence

If the presumption of innocence is for the defendant, and the defendant is innocent until proven guilty, how can they keep him in jail after 5 years and a deadlocked jury?

👏🏿👏🏿👏🏿👏🏿👏🏿👏🏿 the gov didn’t proof their case to take a person life with so many reasonable doubt and holes in this case.

So I heard the state say bortins phone was broke the day of the murder. So surely that means bortin could of been using mellys phone that night when they was in the car.

Does that mean that anyone who is poor cannot get a decent defense? Many years ago I was a victim of an appointed attorney who refused to defend me. He insisted i plead guilty, but i wasn't. The commissioner refused a new attorney. I pled my case in the hallway where we were all waiting. My tormentor's attorney was aghast when he realized what his client had done in his attempt to terrorize me and that he had broken into my house and left the summons on my coffee table while i was gone. I only knew that was improper service because of TV and court proceedings i had done pro se in family court on behalf of foster kids. I learned a lot doing that. My attorney and the unjust commissioner were shameful. Imagine all who had no help in their cases.

Would it be easier to convict if they remove death penalty

They definitely need to get new jury them guys was so ignorant and didn't pay attention at all. The group of people on the jury was pitiful

Just hope a different DA presents the states case in the next trial.

Defendants should get their lawyer fees reimbursed by the state if they aren't convicted. This would also cut down on pros charging innocent people.

Take the d penalty off and just go for life without parole and he’ll be put up for ever if he is guilty .I think he is guilty .he didn’t testify cause he guilty .

Bortlen didn't change cloths!! if you watch the video from them leaving the studio you can clearly see Bortlen carrying the long sleeve shirt in his hand. He simply just put the shirt but its not like he planned a change of cloths.

State needs bortlen, Melly gf or Fredo to testify against Melly without that it’ll forever be a mistrial

This is how the system exhaust funds. Now melly has to pay for another trial. He’s been locked up for years no bond, not able to earn $, now he stays in there for another trial still not earning money, probably having to pay almost a Mil more. The average person doesn’t stand a chance.

The state should have dropped the death penalty, most ppl won’t sentence a person to death if there not 100% sure There asking a lot with no motive and hardly able to keep him in the car
