On 27th August 2022, Justice Uday Umesh Lalit will take over as the 49th Chief Justice of India, the highest-ranking officer of the Indian federal Judiciary.

He replaces Justice NV Ramana.

As head of the Supreme Court, the chief justice is responsible for allocating cases and appointing constitutional benches at the top court. But the constitution of India does not mention any procedure for appointing the CJI.

So, how is the Chief Justice of India appointed?

Fortunately for India, the CJI designate sounds very elegant and erudite and not partisan. It is a huge injustice and loss to the nation and to this great man himself if he is allowed to retire just after a two months. Some reports say that our SC will have 8 CJIs in coming 8 years and it will be highly destabilising. Government should immediately consider to fix a minimum period of one year to each of them in the row by fixing a "date of superannuation or minimum period of one year which ever is later" clause.

Now the thing which is not clear is that how an HC Judge becomes an SC Judge? Can anyone clarify the journey from a district level/sub-divisional level judge to the apex level?

It should be a very very laudable process which would earn the respect of the people of the world. Its not good to play with fire too much. Competency must be the main criteria. Uproot the collegium way which tarnishes bharats image abroad as well as in india. Set an unreproachable procedure. JAIHIND

Prime minister should focus to end the parivarvad in the Judiciary also.Parivarvad in politics cannot be essentially portrayed as it involve no will of people . But in judiciary it is always against the will of the people as it is neither their will nor in their interest to confine, at least in the apex court, the selecion of judges who wield the immense poweron their volition, to a handfull of parivars.Till now most of the Judges were the progeny of the eminent(?) of the judiciary, both bar and bench.... Now a scenario of even CJIs make family rows is there. Prime minister should try with a brave heart to put down such interests by introducing a transparent, non- entitlement oriented appointment of judges especially CJI s which do not smack of favouritism. He must ward of any danger to democracy and constitution by highly opinionated masters who can pose just tweaking their rosters as four judges famously pointed out.

Judiciary should not be appointed or elected either by collegium or by parliamentary committee only. It must be recruited by upsc or alike bodies. If needed create a new recruitment commission like upsc. After clearing exams like pcs-j, and after obtaining experience of 20 years or more in district or sessions courts. Such Candidates should be considered by NJAC or alike committee for HC or SC judges. So that a little comman man can become a SC-CJI one day. Not like pm ka favourite ya CJI ka favourite. Lekin hona kuch nhi hai kuki " gore gye kaley aye"

I think convention is totally unfair... judges appointing judges decision affect people and people have no role in appointment of judges...elected officials should have some say i appointment of judges

The video says Constitution does not mention any procedure about appointment of CJI. But doesn't
clause (2) of Article 124 of the Indian Constitution say the Chief Justice of India and the other judges of the Supreme Court are appointed by the President ?
