The Guardian and Captain America were both created by Joe Simon and Jack Kirby, so they were really ripping off themselves.

So they both have shields, big deal.
Since when is Guardian's shield indestructible? (I stopped reading DC with the New 52, so I don't know if that's a thing now). Since when is Guardian considered a natural leader? Embody the soldier architype? Also, Cap does not have super powers.
Since they were both created by Simon and Kirby, I don't see this as one company copying another anyway.
