Yes, Google photos is doing the scanning in the cloud, but that's because they are REQUIRED to by LAW. All cloud services must do this scanning. Google isn't doing it for photos stored on the phone. There's a massive difference between the two and Google's scanning only happens when the user chooses to upload a photo to the cloud, not when they choose to save a photo to their device.
