DOGE is running wild in the District of Columbia. Chaos reigns supreme. Trump 2.0 has been frightening and it’s all been happening so fast. But there are lots of people fighting back, as they try to slow the damage. And the courts are exactly where the pushback has been most fierce. One of the teams of people leading the charge includes former Judge Nancy Gertner, one of the many legal professionals suing the Trump administration. Judge Gertner's case is about the list of rank and file FBI agents threatened with retribution and the public disclosure of their names, because they did their jobs and prosecuted January 6th cases. Gertner is involved with a slew of cases from the State Democracy Defenders Fund. She talks with host Dahlia Lithwick about the many wins against the administration in court this past week, and whether they matter. Next, Slate senior writer Mark Joseph Stern joins Dahlia to update us on the DOGE litigation and the Birthright Citizenship cases.

this is what the people voted for and the black population in the U S is 12% so

I'm glad to hear the Plaintiffs are "racing back" to set the record straight - but how on earth didn't they have data experts on hand to IMMEDIATELY jump up and say, "actually Judge, DOJ just LIED to you!"?

It is not a Coup, it is the Will of the American People in accordance with the Law and Constitution.

What a great, clear episode. Thank you, Dahlia Lithwick and Judge Gertner.

They shouldn't even have access to LOOK AT THE DATA. And it's obvious they were changing code - otherwise the payments could not have been halted!

Thank God we have President Trump to save this country. ❤

Did you see the video of the DOE employees or security getting all bowed up at Congress people that wanted to go in and see what the DOGE bros were doing? I wish they would get that protective and righteous when the DOGE bros are trying to go in

It is the third bucket. Let's be realistic.

It's clear your guest's primary expertise is on the " people" side of the equation - Federal Civil Service and Birthright citizens. Can you do a second interview with a specialist in data + impoundment issues?

We don't live in a democracy 🙄🙄🙄🙄

It is intentional 100% Project 2025 discusses this and the author argues for a weak admin government and a president that is like a king per se. The document is like 100-200 pages long but I recommend everyone to read it.

14 minutes in. Disnt some of Trumps supporters think Gov was already acting lawless. I remember Twitter files and border wnforcement being 2 contentious issues during prvious administration where no one on left seemed to mind. so we know if legal or not. That was alot of executive orders and he has an eviroment of supporters who do not question actions of this guy. But lawlessness seems to be an ongoing issue from past

Can the Plaintiffs get an order stating that any and all data acquired by DOGE cannot be USED in any Federal action against any U.S. citizen?

Once you've brazenly violated Federal Civil Service protections, data privacy laws, and impoundment prohibitions, there are no other vital areas left to brazenly violate.

10:30 recently warched an interview of a person who was permitted to speak at rally on Jan 6 but got swept up in moment and entered capitol and gave speech on medical rights then was charged with some law drafted after Enron scandal amd was going to possibly face 20yrs prison so plea bargained to misdemeanor charge of tresspass or something then still got 60 days. Kinda seems whacked. If DOGE is providing transparency to how taxpayers money is spent how is that un democratic? Maybe there is abetter way but what? Also lots of opinion here but spoken well. Thanks for show thus far
