You are not paid 100% of your wages in a workers comp case in SC. You are paid what is known as your comp rate that equals 2/3 of your average weekly wage.
- How is the compensation rate determined? That's a question that I get when we're dealing with worker's comp. Your comp rate is 2/3 of your average weekly wage based on your four quarters prior to your injury. But it can't be no more than the maximum comp rate that's determined each year by the Workers Compensation Commission. So, that's kind of the shock to the system when you're not gettin' your full paycheck. In 2021, that's $903.40 is the max comp rate. And if you're working more than one job, all those wages can be put together to determine your comp rate.
