It's rather mis-use of the technology or even personal vendetta by the police.

It's a challenge for camera to extract meaningful info in low light condition if you skin tone is dark.

This is practically a new technology still under development It shouldn't be used to determine nobody's feature without rechecking in the results.

It's like throwing a beta needed to be tested for production.

The app might have be tested on enough white subjects, but not enough Black subjects.

Or probably the algorithm for the face doesn't understand Black faces yet. It might be working inefficiently with deep shades.
