The FTC Appealed The Microsoft Activision Win: Now What?

The FTC has filed an appeal to the 9th circuit court to continue the preliminary injunction against the Microsoft Activision merger. If successful, Microsoft would likely need to return to court to fight the FTC yet again and they seem prepared to do so. So what's next? What's happening with the CMA? Let's go over it all right now... The hope from Microsoft is the FTC appeal denied, but as the FTC appeals Microsoft Activision merger hopes it'll be a tricky case for the 9th circuit to approve given the facts. While the FTC Appeal Microsoft Activision case may result in a denial, they are doing their due diligence in this case.

Previously: The Microsoft FTC Trial has come to an end and Microsoft wins Activision vs the FTC concerns. That's according to the filing from Jacqueline Scott Corley who has denied the preliminary injunction allowing Microsoft acquires Activision. The CMA Microsoft talks have also begun shortly after this reveal, and outline how a small concession could allow the final days of Microsoft buying Activision to arrive. The FTC could still appeal the decision but an FTC appeal Microsoft Activision rumor would need to be filed in a very timely fashion.

The FTC just lost 25% of the budget today when Lina Khan overstepped her boundaries and got slapped down by the Judicial Court. And, that is my question. What court in America after a clear judgment from Corley would allow this appeal to happen? According to court today their appeal will not go through. This is madness to me and a clear vision that the FTC is being ridiculous with not taking the L.

I'm just a lawyer so what do I know, but just so everyone understands what's going on, Judge Corley did NOT reject the appeal. She has no control over the FTCs appeal. She DID deny extending the TRO which means the current TRO will expire tomorrow and Microsoft is free to close the deal. By the time the 9th Circuit reviews the appeal you'll probably have ABK games on Gamepass. Notwithstanding that fact, the Circuit court will likely deny review of the appeal because the FTC blatantly did not meet their burden of proof. Therefore, rejoice Microsoft fans, we have won.
