Actual malice does not mean what was stated at the beginning of this video. The Sullivan court stated that "actual malice" means that the defendant said the defamatory statement "with knowledge that it was false or with reckless disregard of whether it was false or not." It has nothing to do with intent, which is the normal meaning of the word malice. 3:24 in the video points towards the legal meaning of "actual malce" when he says, "Oh you got something slightly wrong." It is ok to be slightly wrong if you did not know it was false and took a reasonable effort to check the facts.
