That's about when the police have to RECITE the Miranda warnings. All the rights within the Miranda warnings are yours all the time. In custody or not. Detained or not. And they are even MORE significant if the police actually say, "You're under arrest, " and then don't recite those warnings before continuing their questioning. At no time are you required to incriminate yourself. At no time are you required to assist them in ANY way with their investigations no matter who or what it is they're claiming to investigate. They are, however, permitted to LIE TO YOU, so it's in your best interest to STATE that you are exercising your right to remain silent and are demanding an attorney before any further questions are even asked.

If a police officer detains someone and questions them about a suspected crime, that is custodial detention and miranda rights must be read.

This only related to the WARNING. Every individual has the right to remain silent etc etc at ALL times (with a few very limited exeptions.) Law enforcement is only required TELL (ie warn) you about those rights at certain times.
