Virginia requires cops who run a Breathalyzer to have special training and certifications. That makes it especially obnoxious when they screw up or act reckless, noting that cop literacy and responsibility levels result in around half of police records having some form of errors. Maybe people at that level of performance shouldn't be trusted with badges or guns?

OTOH, I'd favor treating drunk driving as a form of felony assault with a lethal weapon, and not a socially normalized common pathology. That opens a slippery slope however, when some drivers slightly drunk based on BAC are better drivers than others while sober, or when tiredness, stress, distractions from kids or personal issues, etc, can all impair driving in ways a legal system with equal protections and Proportionality tests for Due Process cannot functionally evaluate rationally.

Andrew was sharp to pick up on this legal defect, but misrepresents a key claim of this video. A small PD in VA would be either a rural county, or a non-independent town operating within a county and using that county's Sheriff's Office to process cases.

They would have between zero and five officers trained and certified to operate a Breathalyzer, not the entire department. The "small hamlet in VA" depiction implies most likely only one to three guys likely were on call to hop out of bed and show up when the arresting officer hauled in the subject between 2300 and midnight a year ago.

Maybe Joe should’ve not been drinking and driving in the first place? Good job getting him off on a technicality, he won’t do that again and kill somebody. Good lawyer, bad Joe.

Getting off on a technicality... He still could have been a danger to the community though. I'm not a fan of charging people with DUI if they've done nothing wrong. Instead I'd make the penalty harsh if they screwed up. Like someone who kills anyone with their mistake would never be allowed to drive again.

The timing of these checkpoints can be quite questionable. Once I encountered one on my way to church with my family mid Sunday morning! That's gonna be a low hit rate. But they were exercising their authority. I told them they'd likely catch a lot more drunks if they set up right after "last call" and between a bar and people's homes, not in rural areas close to churches and far from bars. Then they told be they were looking for unlicensed drivers. 😂 Okay, on their way to church, sure.
