Special counsel dismisses Trump’s notion classified documents are personal records

Special counsel Jack Smith urged the judge in Donald Trump's classified documents case not to entertain the idea that Trump had any personal ownership over the materials in question.

Jack smith is NOT the one who will decide the issues here. The judge has asked him to explain. HIS position. He cannot do that just by whining about how Trump’s position is “fundamentally flawed”. He needs to explain WHY Trump’s position is flawed and, in doing so, he must cite statutory code that says “although Bill Clinton did exactly that AND prevailed in DC District Court when he was challenged, Trump is not allowed to do it”. Problem is, there IS no statutory law that says that. And there definitely is no case law to support Smith’s position since the ONLY case law on this subject is none other than that Bill Clinton case which said HE could do it. So Smith is going to have to come up with a good excuse for WHY Bill Clinton can do but Donald Trump CAN’T. Jack Smith’s biggest problem here is that he overcharged. See, EVEN IF, Jack Smith could find a single sentence in the PDR that says a President can claim every document in his office as personal EXCEPT FOR documents marked “classified”, the Presidential Records Act has no provision that criminalizes acts that violate the Act. EVEN IF the PDR denied a President the right to keep classified documents, Jack Smith STILL could not charge Trump with a crime because the PDR does not say it is a crime to violate the Act. So…Jack Smith decided to call it ESPIONAGE! Problem there is, nothing in the Trump scenario that even remotely matches the definition of Espionage so…..how is he going to prove his case when he can not say “this is how the law defines espionage” and here is what Trump DID that legally qualifies as espionage! So now you know why Jack Smith is so frustrated.
