Legislation and higher courts set parameters for claiming maintanance .first one when cause of action arises.plaintiff claim that defendent not pay maitanance from last so and so months.marriage is intact still now.wife is entitled dower, she is willing reside with him but he not ready to pay maintanance .in this discussion important factor is that financial status of husband/father, his property, Bank balance, and life style from which court can assumed his paying capcity for fixing rate of maintanance
