What is an heir at law? Quite simply, an heir at law is someone who's going to inherit your property when you die. Sometimes it's referred to as next of kin. It's usually your children or a surviving spouse.

If you have neither of those things, then it's usually your parents. And if your parents have predeceased you, then it's going to be your siblings, and then it goes out to cousins, second cousins, aunts and uncles, things like that, based on your state tenancy laws.
