In this video I discuss just how and why it is not illegal to break out of German prison. Germany and only three other countries in the world don't currently have a system that represents a prison escape law, meaning that actually escaping from prisons is not legal those places. Germany also does not believe in life in prison. Citing that a persons reaction is their worst when they have nothing to lose and also, it fills up prisons and burdens the economy. So criminals don't have to ever count on doing 60 years sentence in Germany. I appreciate your few minutes to watch the vid and I hope you enjoy.

Great topic to add to the German Prison system video. Not criminalizing or punishing someone for the simple human desire to be free speaks volumes to the growth and character of the German people.

This is very interesting as is comes on the heals of the current global climate. It would be good to hear an Americans perspective on Germany’s fighting stance as it watches the bar fight from the two bar stools away.

I think the latest escape was at 3. January 2022. A 40-year-old prisoner has escaped from the prison in Brandenburg an der Havel, who was convicted of theft. He escaped from the "open prison" at around 8.30 on Monday morning. An immediately initiated manhunt has so far been unsuccessful. According to the ministry, the 40-year-old still had to serve two "substitute prison sentences" with a total duration of 150 days until May 2022. (so he did not want to wait until May....)

"Substitute prison sentences" are enforced when fines are not paid. In the "open prison system", prisoners are to be prepared for life in freedom. There are no or only reduced measures against escape. Ideally, this means that the prisoner leaves the prison in the morning and goes to his workplace. After finishing work, he immediately returns to the prison and stays there until the next morning, unless he has a day out or vacation.

Brandenburg an der Havel Prison, built in 1927, is the oldest prison in the state of Brandenburg, Germany.

I just watched one of your videos where you said you had a soft spot for film making and I thought that that was a bit ironic since it was „just“ a reaction video. But now that I have watched this video with creative and clean editing and ideas I feel for a lack of better words „disproven“. Keep up the good work and keep expressing yourself!

As there (usually) are no government issued prison outfits there is usually no theft involved in 'stealing' said outfits. Prisoners usually get to wear their own clothing, making them indistinguishable from any other person on the street. Especially in the predominant model of the so-called "Offener Vollzug", the open prison term for most non-violent crimes with prisoners that have a low probability of trying to escape.

Sure, inmates escaping usually require some kind of material to facilitate their escape which they normally can't own legally, and usually don't get away without damaging some kind of property during their escape.
But IF they do escape without causing any such additional damage, or without committing additional crimes either during their escape or afterwards, their sentence is not extended.
Sure, any kind of leniency they had recieved for good behavior or such would normally be canceled. But no additional time is added to their sentence *JUST* for escaping.

For me, that is a totally reasonable argument I can readily follow.

The desire for freedom is not illegal, that's true. But if you damage the prison during the outbreak, then of course that is property damage. And if you take a hostage to get out, that's of course a crime.
But if you just run away to be free, it can never be a crime and that's a good thing!

I'm german and honestly, there are pelple that just deserve to stay locked up forever, or just straight up dead, but I would never blame them for trying to escape, thats literally a primal instinct. To be free, I mean.

I can’t wait to move to this country one day! They are ahead of the US in many ways including their prison systems.

I think the way the US treats criminals is creating a mentality that there are good people and bad people. The reality of it is that there’s good and bad in everyone. We should work to bringing out the good in people when they get lost not punishing them. If you treat people like animals they’ll act like animals. Maybe we should treat prisons like rehabilitation.

I had a friend who was charged guilty because of not paying his bills and stuff like this and also for riding trams and trains without a ticket (wich is a law, wich should be banned imo!).
So he had to go to a prison here in germany.
It was not a high security prison, but it was, you know, f'***ing prison.

I was really amazed, when he told me, that this exact prison didn't even have big walls around it, so fleeing it, would be rather easy.

But as you allready told us in this video, he needed to serve his time, wich was just some weeks, so it would absolutely not be worth the trouble.

To keep things clear, please keep §§ 113 - 121 StGB in mind. It is technical impossible to "leave" a german prison without committing more than one of the crimes described there unless the sentence is over or absolved. As well it is illegal to help somebody else to escape from prison. A certain time before his sentence ends they let an inmate get orientation about the world outside, so they can have "Freigang", especially when there is a family to visit or if they have or will have work outside to earn their future life. Especially high profile inmates having been board directors of big companies or similar folks can work half a year after they begin their sentence. They leave prision every labor day and come back in the evening like a normal commuting employee. I think there we have a problem in the equality of treatment.

Escaping from prison is only legal in Germany as long as you don't harm other people. Simply threatening someone with a sharpened toothbrush makes jail breaking illegal.

The difference between the US (and I suspect all Common Law traditions) and Germany (not sure about Civil Law traditions) is interesting. I think it goes deeper. Compare the fact that drinking alcohol under a certain age is not illegal in Germany, unlike in the US.

there have been a few times the case that due to negligence of the guards some door was not peeled off or by construction work a fence was permeable etc. if you do not threaten or hurt anyone or take them hostage, it is just human that you use this opportunity for freedom.what I also find impossible about the US justice system is the adieren of crimes.so e.b 5 times 2 years because you have stolen something 5 times or 5 years for this and 6 years for there usw.in Germany is always punished the worst crime.nobody gets 3 times life imprisonment for 3 murders and of course no death penalty.also, people under the age of 18, i.e. juveniles, cannot be imprisoned for more than 10 years. however, for non-rezosizable persons there is a security warning that can last until the end of life.but these are big exceptions. Basically, hardly anyone in Germany is in prison for longer than 25 years.the people in the USA are and can not be worse people than those in Europe or Germany, so the criminal law of the USA is sick. the U.S. had over 2, 000, 000 convicts in 2021. either Americans are much more evil people or criminal law is inhumane.
