As a Magic player, given the Mulligan analogy, I have to assume that in the follow-up trial, they only bring 11 jurors, and if that one goes to a mistrial, they only draw 10 jurors and so on and so forth down to a minimum of one juror.

I was once selected for jury duty. The jury was seated for less than ten minutes before we were forced to leave the room. After a few hours in the jury room (with free lunch!) The judge came in and told us it was declared a mistrial because of something the first, and only, witness had said. He was pissed.

Objection: The one exception is if it’s a mistrial due to severe misconduct by the prosecutor and the judges dismissed the case with prejudice, the charges are, for all intents and purposes, deemed dismissed and cannot be brought back by a second trial
